Terms of Service
These Terms of Service (“Terms”) govern your use of PhotographyMap.au. By accessing or using the website, creating an account, saving a location or submitting a listing, you agree to these Terms.
1. What PhotographyMap.au provides
PhotographyMap.au is a discovery and location-information platform for photographers, filmmakers and other creatives. Listings may include public places, studios, private properties and other shoot locations. Information is provided for general planning and discovery and may change without notice.
2. No guarantee of access, accuracy or suitability
We do not guarantee that a location is open, safe, legally accessible, suitable for a particular shoot, available at a particular time, or accurately described. Conditions, fees, parking, permits, drone restrictions, opening hours and property rules can change. You are responsible for checking current conditions directly with the relevant owner, authority or operator before travelling to or using a location.
3. Photography, permits and local rules
You are responsible for complying with all applicable laws, regulations, permit requirements, property rules, aviation/drone restrictions, privacy obligations and directions from landowners or authorities. A listing on PhotographyMap.au is not permission to enter private property or conduct commercial photography.
4. Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for activity conducted through your account. We may suspend or remove accounts used for fraud, abuse, spam, unlawful conduct or repeated breaches of these Terms.
5. User-submitted locations and content
When you submit a location, text, image, link or other content, you confirm that you have the right to submit it and that doing so does not infringe another person’s copyright, privacy, confidentiality, property or other rights.
You retain ownership of content you own. By submitting content to PhotographyMap.au, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, display, publish and promote that content for the purpose of operating and marketing PhotographyMap.au. This licence ends when the content is removed from the service, except for reasonable backups, cached copies and material we are legally required to retain.
6. Contributor information
If you choose to provide an Instagram handle or contributor name, you authorise PhotographyMap.au to display that information with relevant listings. You can update your account Instagram handle through My Account. Listing-specific overrides may continue to display until separately changed or removed.
7. Moderation
Submissions may be reviewed before publication. We may edit formatting, correct obvious errors, reject, unpublish or remove listings or accounts at our discretion where reasonably necessary for quality, safety, accuracy, legal compliance or platform integrity.
8. Prohibited use
You must not use PhotographyMap.au to submit unlawful, misleading, abusive, defamatory, infringing or dangerous content; scrape or overload the service; bypass security; impersonate others; collect personal data without permission; or use the service in a way that could harm users, locations, property owners or the platform.
9. Third-party links and services
PhotographyMap.au may link to third-party websites, social profiles, booking services, map providers and other resources. We do not control those services and are not responsible for their availability, content, privacy practices, pricing or transactions.
10. Affiliate links
Some links may be affiliate links. We may receive a commission if you make a purchase or take another qualifying action through those links, at no additional cost to you. See our Affiliate Disclaimer for more information.
11. Future marketplace and booking features
If PhotographyMap.au introduces bookings, payments, paid memberships or marketplace services, additional terms, fees, cancellation rules and payment conditions may apply. Those terms will be presented before the relevant transaction or service is used.
12. Intellectual property
PhotographyMap.au branding, software, interface, original text, databases and other platform materials are protected by applicable intellectual property laws. Third-party and user content remains subject to its respective ownership and licence terms.
13. Disclaimer
To the maximum extent permitted by law, PhotographyMap.au is provided on an “as is” and “as available” basis. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
14. Limitation of liability
To the maximum extent permitted by law, PhotographyMap.au and its operators will not be liable for indirect, incidental, special or consequential loss arising from your use of the service, reliance on location information, travel to a location, dealings with third parties, loss of content, or unauthorised access to your account. Where liability cannot be excluded, it is limited only to the extent permitted by law.
15. Changes and termination
We may change, suspend or discontinue parts of the service and may update these Terms from time to time. Continued use after updated Terms are published means you accept the revised Terms.
16. Governing law
These Terms are governed by the laws of Queensland, Australia, and the parties submit to the courts with jurisdiction in Queensland, subject to any mandatory rights that apply to you.
